甲、乙、丙均系个体经营者，甲因从乙处进货而拖欠其，20万元货款，乙又因借贷而拖欠丙20万元，现离借款到期日还有4个月，乙在征得甲、丙同意后，决定以汇票结清他们之间的债权债务关系，乙作出票人，甲做付款人，丙做收款人，票据金额20万元，出票日后4个月付款，甲与乙之间汇票结算后的尾数用现金了结。丙拿到汇票后为便于流通便找甲进行了承兑。此后，丙从某家具厂进货时，将汇票背书转让给了家具厂。家具厂接收到汇票时距到期日还有近3个月，遂又决定用该汇票采购木材，采购员刘某携带已在票据背面背书栏签有本单位的汇票外出时不慎将其丢失，刘某将汇票丢失的情况告知了家具厂，家具厂立即向甲办理了挂失止付的手续，其他措施未采取。该丢失的汇票被李某捡到，李某发现票据背面的最后一次背书未填写背书人，便喜出望外地签了名，然后持汇票到某家电商场购置了一套价值20万元的家电，并将汇票背书后交给了家电商场。家电商场未进行票据的转让。现汇票到期，家电商场持汇票请求甲付款，甲以汇票已挂失止付为由拒绝付款，家电商场只好追索，并对所有前手发出了通知。家具厂接到通知后提出自己是票据权利人，家电商场的票据权利有缺陷，请求返还票据。双方发生争执，诉至法院。
