案情：在一起伤害案中，一审法院查明下面的情况：林乙将面包厂的柴油机排烟筒对着李某家而引起纠纷。李某要求移开烟筒，林乙未予理睬，李某遂自己将烟筒拔去，为此林乙和李某发生争吵，林乙的哥哥林甲到场后，从李某手中夺下小板凳猛击李的头部，林乙用木棍打击李的右额。李因颅脑损伤死亡。于是一审法院以故意伤害罪判处林甲死刑，缓期两年执行，林乙无期徒刑。林甲不服，以没有用板凳打击李头部而李某是林乙用木棍打击头部致死为由提起上诉。高级法院审理后认为原判认定事实正确，但定性不当，故改判林甲、林乙故意杀人罪，维持原处刑。 判决生效后，林甲后来又发现有新的证据表明案件认定的事实不清，因而不断进行申诉。省高级法院依法受理该申诉材料后，认为符合刑事诉讼法的有关规定，遂由该院院长决定由作出生效判决的合议庭按再审程序审理。经审理认为命伤不是用板凳打击所致，原判认定林甲故意杀人事实不清，证据不足，撤销对林甲的定罪量刑，宣告其无罪。由于林乙并没有申诉，因此对林乙并没有审查。 问题：
